Terms of Use for the Software home.onemed.se
The software home.onemed.se (the “Software”) has been developed by OneMed Sverige AB, corporate ID number 556764-4140, Box 50, 401 20 Gothenburg (“OneMed”) and is provided as a web-based service.
home.onemed.se has been developed to assist Care Recipients in ordering products prescribed by healthcare professionals, within OneMed’s product range, and to enable the delivery of such orders to the Care Recipient’s regular delivery address or to an address specified by the user.
The employer of your prescriber (the “Healthcare Provider”) has entered into an agreement with OneMed regarding the Software and holds a non-exclusive license to use the agreed Software. These Terms of Use (“Terms”) govern your use of the Software, including all associated features and content. By accepting these Terms and/or using the Software, you agree to be bound by the Terms for all use of the Software.
Use of the Software
As a user, you are responsible for ensuring that your use of the Software does not violate applicable laws or these Terms of Use. You may not breach, bypass, remove, or interfere with the technologies or security systems that OneMed uses to protect the Software and its content. Furthermore, you must not act in any way that could disable, overload, impair, or damage the Software, or otherwise cause harm to OneMed.
Intellectual Property Rights
All intellectual property rights, including but not limited to trademarks, copyrights, patents, and source code, as well as features included in the Software, belong to OneMed and/or its licensors and may not be used by you except as required for the use of the Software in accordance with these Terms of Use or as permitted by mandatory law.
Any intellectual property rights that may arise through the use of the Software shall be the property of OneMed. You may not modify, translate, reproduce, copy, or transfer the Software, except where expressly permitted by law.
Handling of Personal Data
When using the Software, personal data such as your name, prescribed products, and historical delivery information is processed. This data is handled for the purpose of identifying you at login and ensuring your authorization to access various features of the Software.
OneMed processes your personal data on behalf of the Healthcare Provider. In the context of personal data processing within the Software, the Healthcare Provider is the data controller, and OneMed is the data processor, along with any subcontractors where applicable.
A data processing agreement has been established between OneMed and your Healthcare Provider.
To request access to your data in accordance with Article 13 of the General Data Protection Regulation (GDPR), please contact your Healthcare Provider.
Operational Reliability
OneMed aims, to the greatest extent possible, to provide the Software without technical disruptions or errors. However, maintenance work, further development, and/or other issues may limit or temporarily prevent your ability to use the Software.
OneMed reserves the right to carry out scheduled updates and maintenance of the Software without prior notice.
Limitation of Liability
The Software is merely a tool that facilitates the ordering of products prescribed by the Healthcare Provider’s personnel. The Healthcare Provider’s personnel are responsible for the selection and prescription of products for you as a care recipient.
OneMed is not liable if a selected product fails to meet expectations or is otherwise unsuitable for the care recipient. Accordingly, OneMed bears no responsibility for the products ultimately prescribed to a care recipient.
The Software only displays products that have been prescribed by the Healthcare Provider’s personnel. OneMed does not guarantee the accuracy of information related to procured products. The Software is developed to support the latest versions of web browsers for desktop and laptop computers. OneMed does not guarantee support for older browsers.
Beyond any liability that may arise under mandatory legislation, OneMed has no obligation to compensate you for any damages resulting from the use of the Software or from errors or interruptions in the Software. OneMed is therefore not liable for any direct or indirect damages or losses, including loss of income.
Changes to the Terms of Use
OneMed reserves the right to modify these Terms of Use from time to time. You will be notified of any material changes within a reasonable period before they take effect. By continuing to use the Software, you are deemed to have accepted the amended Terms of Use.
Dispute Resolution
Swedish law shall apply to these Terms of Use. Any disputes arising in connection with the Terms shall be finally settled by arbitration in accordance with the Rules for Simplified Arbitration of the Arbitration Institute of the Stockholm Chamber of Commerce. The seat of arbitration shall be Stockholm, and the language of the proceedings shall be Swedish.
